Terms and Conditions

Use of the Online Store

Using this online store gives you the status of Customer and implies acceptance, fully and without reservation, of all the provisions included in the General Terms & Conditions, and in the Privacy Policy, in force at each time you access the Online Store.

If you do not fully accept any of the conditions established, you should not access/use the online store.

Fundação Batalha de Aljubarrota reserves the right to change and update the General Terms & Conditions periodically and without prior notice to the Customer.

The processing of personal data carried out by Fundação Batalha de Aljubarrota complies with current legislation on data protection, namely Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and the free movement of such data (“General Data Protection Regulation”) and other applicable community and national legislation, to which the Customer gives express authorization.

All information provided by the Customer must be accurate and truthful. The Customer is obliged to update the information provided to Fundação Batalha de Aljubarrota whenever it undergoes any changes. The Client is expressly responsible for any false or inaccurate statements made and for any losses caused to Fundação Batalha de Aljubarrota or third parties, with the information provided.

Fundação Batalha de Aljubarrota is the entity responsible for processing the personal data of its Customers, whose legal basis for processing is the execution of this purchase and sale contract.

In the event of violation of the General Terms & Conditions, Fundação Batalha de Aljubarrota reserves the right to take any and all legally prescribed action. Furthermore, it also reserves the right to, at its discretion, terminate access to or use of the online store, with or without notification to the Customer.

The Batalha de Aljubarrota Foundation applies the appropriate and necessary technical and organizational security measures to ensure information security. However, the Customer is aware that the use of the online store may not be 100% secure, so there is a possibility that the information sent/received may be intercepted by unauthorized parties, and this fact cannot be attributed to FBA.

The contractual proposal contained in the online store is aimed only at people of legal age, with the Customer accepting that it can only be used by users over the age of eighteen and with full contractual capacity and who, therefore, can be responsible for the commitments resulting from the purchase and sale.

Online Purchase Procedure

The CIBA online store (Battle of Aljubarrota Interpretation Center) is managed by the entity Fundação Batalha de Aljubarrota, a foundation with headquarters at Rua Dom Nuno Alvares Pereira, nº45, 2º Direito, 2480-062 São Jorge and legal entity nº 506060799. All products ordered on this website are invoiced by Fundação Batalha de Aljubarrota. 

1st Step – Selection of items to include in your shopping cart

(the price is indicated in Euros, including VAT at the legal rate in force).

The Customer hereby expressly accepts and acknowledges that:

  • The images of the products presented in the online store are for illustrative purposes only and the Customer must carefully and fully read the information on the essential characteristics of the articles, and can, in case of doubt, contact us by telephone number 244 480 060 or email loja@fundacao-aljubarrota.pt or go to the store (from Tuesday to Sunday, from 10:00 to 17:00) Fundação Batalha de Aljubarrota, in order to obtain any additional information or details;
  • Fundação Batalha de Aljubarrota will make every reasonable effort to include accurate and updated information about the products available on the website;
  • The prices of the items indicated in the online store correspond to the full amount payable by the Customer.

2nd Step – Registration / Form Filling

For the purpose of confirming your order, the Customer will have to fill out a form, in which they must indicate:

  • Client name;
  • Telephone contacts and email addresses of the Customer;
  • Customer’s NIF/NIPC to appear on the invoice;
  • Customer address to appear on the invoice.

3rd Step – Confirmation of the items and services included in the shopping cart, Buyer Data and Billing and Payment Data.

The Customer undertakes to carefully check the data contained in their order summary, confirming the items and services selected in the shopping cart, Customer data and billing data, and must then return to the previous steps in order to carry out the respective rectification if any non-compliance is detected.

Fundação Batalha de Aljubarrota will acknowledge receipt of the order via email sent to the email provided by the Customer.

The invoice will be sent or delivered upon collection or delivery of the purchased products.

Delivery Methods

Store Purchase Survey

The customer can choose to collect their purchase online at the Battle of Aljubarrota Interpretation Center Store, located at Avenida D. Nuno Álvares Pereira, nº 120, S. Jorge, 2480-062 Calvaria de Cima. At the time of collection, the Customer must check all the merchandise contained in the packaging, their quantity and condition.

If you detect defects or damage to the products and/or if they do not match your order request, the Customer must identify the damage or defects either by calling 244 480 060 or by email loja@fundacao-aljubarrota.pt from (Tuesday to Friday: 10:00h-17:00h).

Home Delivery of Purchase

The delivery service is only available to addresses with postal codes between 0000-001 and 0000-499.

The cost of home delivery is the responsibility of the customer and the customer is informed of the cost when selecting the delivery method, which is immediately debited.

In case of unavailability of products for delivery, Fundação Batalha de Aljubarrota must inform the Customer, within a maximum period of 2 days from becoming aware of this unavailability, refunding the amounts paid, if the Parties do not agree on a new delivery deadline.

The Customer undertakes to appear at the location on the agreed date and time to receive the goods. If it is not possible to deliver the goods due to the Customer’s responsibility, the costs related to second deliveries will be borne by the Customer.

DELIVERY CHECK

Upon receipt, whether for In-Store Collection or Home Delivery, the Customer must immediately check the condition of the purchased products, their quantity and condition. If you detect defects or damage to the items and/or if the items do not match your order request, the Customer must contact Fundação Batalha de Aljubarrota for the Store +351 244 480 060 (Tuesday to Friday: 10:00am- 17:00).

TERMINATION OF THE CONTRACT

In accordance with the provisions of article 10 of Decree-Law no. 24/2014, of February 14 (updated by Decree-Law no. 78/2018, of October 15) the Customer enjoys the right to free resolution, which may be exercised without the need to indicate the reason up to 14 (fourteen) days after the date of delivery of the items, in which case the Customer agrees to be responsible for paying all transport charges for collecting the items between the delivery address to the headquarters of the Batalha de Aljubarrota Foundation.

EXCHANGES AND RETURNS

The customer may return/exchange any product, due to defect, within the legal deadlines for this purpose, however, if they wish to collect it, they will bear the shipping costs.

CLAIMS

The Customer may direct any complaints to Fundação Batalha de Aljubarrota, using the contact details available on the contact page or send it to its headquarters.

APPLICABLE LEGISLATION AND JURISDICTION

For any divergence arising in the contractual relations between the Parties, Portuguese legislation will apply. Any question or dispute arising from the application, interpretation, integration or execution of this Agreement, when it cannot be resolved by agreement between the parties, will be submitted to the Portuguese courts. The consumer may also resort to Alternative Dispute Resolution Entities, available at www.consumidor.pt. In the event of a consumer dispute, the consumer may resort to the network of consumer dispute arbitration centers authorized to carry out information, mediation and arbitration activities in consumer disputes. CNIACC-National Center for Information and Arbitration of Consumer Conflicts (website: www.cniacc.pt).

PRIVACY POLICY

Fundação Batalha de Aljubarrota collects the customer’s personal data for the purpose of managing customer accounts, billing, providing information, as expressly authorized for this purpose, all in accordance with the terms indicated above and the legislation in force.

This information derives from the provisions of article 18 of Law 114/2015, of 8 September.

The Customer declares to know and accept fully and without reservations these General Terms & Conditions of Online Purchase and Sale.
